Customer Terms

This Customer Terms Agreement forms part of the TradesLink Terms and Conditions. By creating or maintaining a Customer account on TradesLink, you agree to be bound by this Agreement and all other applicable TradesLink policies.

1. Purpose

This Agreement explains the rights, responsibilities and obligations of customers using the TradesLink platform.

2. Eligibility

To create a Customer account, you must:

  • be at least eighteen (18) years of age
  • have the legal capacity to enter into legally binding agreements
  • provide accurate and truthful information
  • comply with all applicable South African laws

TradesLink reserves the right to suspend or terminate accounts that do not satisfy these requirements.

3. Customer Responsibilities

Customers agree to:

  • provide accurate job descriptions
  • disclose relevant information that may affect the work
  • provide the correct job location
  • communicate honestly and respectfully
  • cooperate throughout the booking process
  • inspect completed work within a reasonable time

Customers remain responsible for ensuring that the requested work and instructions are lawful.

4. Posting a Job

When posting a job, customers should provide, where reasonably possible:

  • a clear description of the required work
  • photographs where helpful
  • the work location
  • any access requirements
  • their proposed budget

Providing accurate information helps TradesLink connect customers with suitable tradespeople.

5. Selecting a Tradesperson

TradesLink introduces customers to independent tradespeople. The decision to proceed with a particular tradesperson remains the customer's responsibility.

Where a tradesperson displays a "Verified" status, this indicates only that certain information has been verified by TradesLink. It does not guarantee workmanship, reliability or future performance.

6. Communication

Customers acknowledge that communications relating to platform-managed jobs may occur through TradesLink's designated communication process, including WhatsApp where applicable.

Customers agree to communicate respectfully and professionally.

7. Pricing

Customers and tradespeople are responsible for agreeing on the final job price before payment is made. TradesLink does not determine labour pricing.

Once payment has been made, changes to the agreed scope of work should be communicated to TradesLink before additional work proceeds.

8. Payments

Customers agree that payment for accepted jobs must be made through TradesLink's approved payment process.

TradesLink temporarily holds customer funds until the job has been completed or otherwise resolved in accordance with TradesLink's policies.

Customers must not make direct payments intended to avoid TradesLink's payment system.

9. Job Completion

Customers should inspect completed work within a reasonable time.

Where the customer believes that the work has not been completed as agreed, the customer should notify TradesLink promptly and provide supporting evidence where available.

If the customer becomes unresponsive after reasonable attempts to obtain confirmation, TradesLink may determine whether the job has been substantially completed based on the available evidence.

10. Cancellations

Customers may cancel jobs in accordance with the TradesLink Cancellation & Refund Policy. Applicable cancellation fees may apply depending on the stage of the booking.

11. Reviews

Customers may submit reviews based on genuine personal experiences. Reviews must:

  • be truthful
  • relate to an actual platform transaction
  • avoid abusive, discriminatory or defamatory language
  • not contain knowingly false or misleading information

TradesLink reserves the right to remove reviews that breach these requirements.

12. Customer Conduct

Customers must not:

  • provide false information
  • threaten or harass tradespeople
  • discriminate against users
  • submit fraudulent payment information
  • misuse the platform
  • intentionally damage a tradesperson's reputation through false allegations
  • encourage payment outside the TradesLink platform

13. Property Access

Customers are responsible for ensuring that tradespeople have reasonable access to the property at the agreed time.

Where access cannot be provided, customers should notify TradesLink and the tradesperson as soon as reasonably possible.

Repeated failures to provide access may result in cancellation fees or other action under TradesLink's policies.

14. Safety

Customers should provide a reasonably safe environment for tradespeople. Customers should disclose any known hazards that may reasonably affect the safe performance of the work.

15. Liability

Customers acknowledge that tradespeople are independent service providers.

TradesLink does not perform the work itself and does not guarantee the quality, safety or outcome of services provided by independent tradespeople.

Nothing in this Agreement excludes any liability that cannot lawfully be excluded under South African law.

16. Account Suspension

TradesLink may suspend or permanently terminate Customer accounts where users:

  • repeatedly abuse the platform
  • submit fraudulent claims
  • intentionally provide false information
  • attempt to circumvent the platform's payment process
  • repeatedly violate TradesLink's Terms or Policies

17. Privacy

Customers acknowledge that personal information will be collected, processed and stored in accordance with the TradesLink Privacy Policy.

Customers should respect the privacy of tradespeople and may not misuse personal information obtained through the platform.

18. Compliance with Laws

Customers agree to comply with all applicable South African laws when using the TradesLink platform. Customers may not use TradesLink for unlawful, fraudulent or prohibited activities.

19. Changes to this Agreement

TradesLink may amend this Agreement from time to time. Updated versions will be published on the TradesLink website. Continued use of the platform after changes become effective constitutes acceptance of the revised Agreement where permitted by law.
